Terms & Conditions

Eco-Burial Inc. (also referred to as EBI) is governed in Canada by The Cemetery Companies Act of New Brunswick.

Eco-Burial Inc. is the sole source vendor of EBI Interment Rights Certificates for cremated human remains. EBI may designate by contract, agents and organizations to present EBI options to potential clients. Their designation will be recognized by EBI codes unique to each agent and by letters of authorization. All transactions must be completed through the prescribed EBI purchase process and purchasers shall receive a contractual guarantee of sanctuary.  The Cemetery Companies Act provides that this is a forever contract, in perpetuity, and with EBI, this sanctuary is presented beneath a canopy of maturing Acadian forest in conjunction with life sustaining carbon sequestration and wildlife refuge protection. Upon completion of the online purchase agreement and after being in receipt of full and confirmed payment for thirty (30) business days, Eco-Burial Inc. will issue an Interment Rights Certificate. The Purchaser will receive online confirmation of the transaction. A paper copy certificate and any other contract(s) outlining  services and products selected as additional to the certificate will be mailed to the address provided in the original on-line contract.

Payment options. INFORMATION: Cemetery Sales Agreement and FAQ’s

Interment rights, services and products are not accessible until Eco-Burial Inc. is in receipt of full payment. The Purchaser will be advised of any default after thirty (30) days of expiration of a contractual commitment, where full payment remains incomplete. Contact will be made via email and written notification (where a mailing address is recorded in the original contract). If payment is not received within sixty (60) days after the date of default notice, Eco-Burial Inc. shall exercise the right to revoke the original purchase contract, and shall retain any previously received payments as liquidated damages. Purchasers agree and accept that a Cemetery Sales Agreement is a legal and binding contract, and shall not invoke payment dispute mechanisms as a payment avoidance action for any contractual obligations.

The Interment Rights Certificate owner is guaranteed legal right of interment for all time, within the designated plot. Ownership of all interment plots within the EBI Nature’s Monument Sanctuary sites resides in perpetuity with Eco-Burial Inc. Where plot consecration may occur or the word “deed” may be used by certificate purchasers, this is not to be construed as granting rights additional to the right of guaranteed interment within the original agreement.

Interment Rights Certificates assign rights in perpetuity. Unless or until, the certificate owner(s) on record with Eco-Burial Inc. has made written arrangements endorsing ownership change or has submitted pre-authorized written instructions for the interment of a person(s) other than those originally named on the certificate, no other person(s) shall have legal right of interment within the plot assigned by the Certificate. Legal beneficiaries of an estate may claim the Interment Rights Certificate through inheritance, and upon presentation of probated last will and testament documents, may assume rights and control, previously invested in the original owner(s). Transfer is subject to Eco-Burial Inc. process approval and with administrative fees applicable.

Cremated remains plots measure one (1) square meter (1.196 Square yards) in size and are limited to two (2) interments per plot. The plot marker pin is at the centre of the square. The first interment will always be north of the pin and any subsequent interment will be placed to the south of it.

Interment limit exception: the Interment Rights Certificate owner, or his / her Executor or legal heirs, may upon written request, and with supporting documents, exceed the two interments per plot limit, where there is an at-need situation for the children or grand children of the Certificate owner(s). Exception will be granted for those of an age up to and including twenty-one (21) years. Exception interments will be placed to the east or west sides of the plot marker pin, thereby preserving space for the original Certificate owner(s). Standard interment fees apply. Interment Rights Certificates shall not be sold or transferred by the owner(s) of record, excepting through the prescribed Eco-Burial Inc. transfer process.

-Relocation of an Interment Rights Certificate plot within the Sanctuary. The Named certificate owner(s) may upon written request, and with payment of a ten percent (10%) administrative fee (applicable to original Certificate purchase price), relocate to another site within the sanctuary. Upon receipt of the original certificate and supporting contract(s), Eco-Burial Inc. will revise and reissue the certificate and documents.

-Transfer of Interment Rights Certificate Ownership. Ownership of an Interment Rights Certificate may be transferred upon written request by either the Named certificate owner(s), or by his or her legal heirs. Inheritance transfer requests must be supported by the prescribed legal documents. Upon payment of a fifteen percent (15%) administrative fee (applicable to original Certificate purchase price), and with return of the original certificate and contract(s) by the applicant, Eco-Burial Inc. will issue a Certificate and contract(s) in the name of the new owner(s).

-Relinquishment / cancellation of Interment Rights Certificate Ownership. The Named owner(s) of an Interment Rights Certificate and purchaser of additional interment services and products (excluding personalized items) may relinquish ownership by written notification to Eco-Burial Inc., and receive reimbursements where applicable, subject to fulfillment of the following terms and conditions. Eco-Burial Inc. must receive written notification from the Named Interment Rights Certificate owner or upon transfer by probated last will and testament, from his or her legal heirs. The original Interment Rights Certificate and any service and product contract(s), as supplied in paper copy to the owner by Eco-Burial Inc., must be returned to the address provided, prior to commencement of the refunding process. Communication and Mailing Address. Eco-Burial Inc. will process a refund to the applicant, upon receipt of the aforementioned documents and upon receipt or retention of a twenty-five percent (25%) administrative refunding fee (applicable to the original Certificate purchase price only). Taxes are reimbursed at the prevailing rate and pro-rated to the amount being reimbursed. Personalized stone markers are not eligible for refund, but the Certificate owner(s) may elect to receive them. Eco-Burial Inc. will ship via postal service, with applicable postage and a $25.handling fee deducted from the refundable amount. Perpetual care fees(5%- five percent of original Interment Rights Certificate sale price) are not refundable. Interment Rights Certificate owners accept and agree that perpetual care is initiated upon their contract signing date. Certificate owners additionally agree that Care is not limited to the allocated plot, and that it also serves the greater benefits of wildlife protection and of life preserving carbon capture, regardless of if, when or how the owner accesses the Certificate interment rights.

Where pre-arrangement is limited to purchase of the Interment Rights Certificate only, the cost of interment and additional services or products become the responsibility of the Executor or Next of Kin, and must be fully paid in advance of interment.

Disinterment of cremated remains originally placed in biodegradable containers is problematic, as it may be impossible to recover the entirety of ash remains. Application must be made by the Executor or Next of Kin with the Province of New Brunswick and is subject to all health and environmental regulations. Administrative, disinterment and site remediation fees will be applicable and are the responsibility of the applicant. Full payment required prior to a work order being issued.

This Nature’s Monument Sanctuary is an eco-sensitive burial site. Traditional headstone monuments are not an option. Certificate owners may source small natural stone markers with engraved names, life dates and a small faith symbol (optional) through Eco-Burial Inc. INFORMATION: Products and Services – Photo Gallery. Certificate owners accept and agree that these markers are placed upon the interment plot, and are not permanently attached to it. Natural forces of weather and wildlife may cause migration from the original point of placement. The plot marker pins will last for several generations and are supplemented by global positioning information and digital records. Paper copy documents and site maps provide additional support. Artificial flowers, landscape shrubbery, vines, hedges, unapproved plantings, vases, fences, symbolic emblems, statuary, etc., are not acceptable, with the exception being, symbols of faith, of a size that may be engraved upon the natural stone marker option. To maintain the integrity of this site and for the safety of visitors, wildlife and employees, any unapproved item will be removed without notice.

EBI Nature’s Monument Sanctuaries are presented in a natural forest setting, with trails to facilitate entrance, and to enhance your visiting experience. You will be in contact with interment plots and are advised that is unlawful to engage in any disrespectful acts within a cemetery. The removal of natural growth, breaking of branches, collection of wild flower, etc., may be considered acts of vandalism (excepting Eco-Burial Inc. maintenance). Both the sanctuary and the surrounding wildlife refuge have been posted with signage identifying the site and with the prohibition of hunting and trespass. Motorized vehicles (excepting Eco-Burial Inc. maintenance units) are prohibited.

Eco-Burial Inc. retains sole responsibility for conducting all interments within the Nature’s Monument Sanctuary. Interments may be scheduled where families and friends have indicated a desire to attend. Faith practitioners, families and friends are welcome to participate in the placing of the urn, under the guidance of Eco-Burial Inc. employees or designated agents. Participants will be entering a natural forest and must ensure their own personal safety by wearing proper hiking footwear and protective clothing.

SURFACE SCATTERING OF CREMATED REMAINS: Family members, friends and executors may surface scatter cremated remains within EBI sanctuaries. Service providers are prevented from performing the service by current legislation. INFORMATION: FAQ’s.

PET INTERMENTS: Nature’s Monument Sanctuary 1 is restricted to human remains interment only. Pets may be placed in an un-forested site separate from NMS1, but within the area overlooking the great valley. Trees indigenous to the Acadian forest will be planted to create similar natural habitat, wildlife refuge and carbon capture benefits. Pet services accessed by prearranged contact only. People of the Earth…

Early survey abstracts describe Nature's Monument Sanctuary 1 as being "the fourth tier of lands beyond the river". We are positioned to the west and nearly atop the gently inclining crest of a great valley. When the ice age glaciers withdrew 13,000 years ago, the land had been contoured by the weight upon it, creating this valley which runs parallel to the Saint John River.
This is a place of solitude and peace, from which our forebears drew life and raised families through good times and the Great Depression. The cultivated spaces were quickly reclaimed by the forest when they grew too old to tend the land. What speaks to them having toiled here are the hundreds of apple trees scattered throughout, and the cairns of stones piled up where they hindered the work. This land has endured a cycle of settlers and farmers, and is now returned to nature as Acadian forest.
